Cruz Label may change, modify, add or remove portions of this Terms and Conditions at any time, and any changes will become effective immediately upon being posted unless we tell you otherwise.
Use of our services:
1. Quotations/Estimates
Prices posted on this website are subject to change without notice. Any changes to your original artwork may affect the quotations/estimates. Written estimates are good for 30 days. An estimate not accepted within 30 days may be changed.
2. Payment Terms
50% payment of estimate is required to process your order and balance must be paid in full prior to shipping. We reserve the right to place your job on hold if the credit card declines or if waiting for payment via check. Checks need to be cleared with our bank prior to processing your order. Any returned checks will be charged a $25 fee and you will need to pay all outstanding balance with another form of payment, such as a credit card or debit card.
To protect all parties from fraud, Cruz Label may request an Authorization Form with a copy of your official ID. If your credit card name and ID do not match, we cannot process your order.
Due to the customization and quick turnaround process, all sales are final. Credits are not available on orders unless the proof has not been generated or the files have not been prepared for production. If an order is canceled after we have sent you a sample, then sample fee cannot be refunded and for woven labels, $80+ fee* will be charged. (pricing depends on the label specs)
There are no cancellations after order has went into production. Should you cancel your order while your order is being processed, you are still responsible for the total balance less shipping.
4. Orders
Cruz Label reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. Cruz Label from time to time may ask customers to submit documents that authorizes the use of certain trademark or copyrighted images or logos. Furthermore, Cruz Label is not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The customer guarantees the legal title of all matter submitted to Cruz Label for printing and/or weaving.
5. Artwork Specification
Quotations are based on the information of the art work provided. Cruz Label can re-quote a job at the time of submission if the artwork does not conform to the information on which the original estimate was based.
6. Liability
Cruz Label's liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. Cruz Label warrants that every product manufactured by it meets industry standard for such product. IT IS THE RESPONSIBILITY OF THE CUSTOMER TO TEST, REVIEW, AND/0R SAMPLE THE PRODUCT FOR THEIR SPECIFIC USE PRIOR TO PRODUCTION AND USAGE. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. Cruz Label makes no other warranty and no actions or words of Cruz Label or its officers, employees or agents shall constitute a warranty.
7. Indemnification
The customer represents that it has the legal right to produce all materials ordered from Cruz Label. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against Cruz Label based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by Cruz Label ordered by the customer: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the customer shall indemnify and hold Cruz Label harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Cruz Label against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing Cruz Label for any legal fees and expenses it reasonably incurs in responding.
8. Storage of Art Work (Digital and Print)
It is the customer's responsibility to maintain a copy of the original computer files, artwork and transparencies. Cruz Label is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the customer. Until Cruz Label can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged a fee. Cruz Label does not archive your work for long periods of time, so it is the responsibility of the customer to save the artwork.
DO NOT send any "one-of-kind" transparencies, prints or artwork.
9. Proofs and Samples
Your sales rep may email you a digital proof of your order. It is the responsibility of the customer to review and confirm all specifications including text, color, size, images, and other options. Cruz Label is not responsible for any errors once the proof has been approved.Once approved, any changes to the proof constitutes a new order and customer will be charged accordingly.
Physical samples may be produced for woven materials. It is the responsibility of the customer to review and confirm all specifications including text, color, size, images, and other options. Once approved, any changes to the sample constitutes a new order and customer will be charged accordingly. Cruz Label is not responsible for any errors once the proof has been approved.
Cruz Label will not be responsible for undetected production errors if:
Proofs are waived by the client;
The work is printed per the client’s written or verbal OK;
If No Proof was selected.
All requests for changes of any kind must be made in writing to avoid mistakes.
10. Colors
For vector graphic images on print, a Pantone ® color code needs to be provided to Cruz Label for accurate matching. If Pantone ® color code is not provided, Cruz Label will use a generally accepted technical method to render the colors. Customers must be aware that because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operations, a variation between color proofs and the completed job [as determined by generally accepted trade technical methods] is to be expected. When such a variation occurs, it will be considered acceptable performance.
For woven materials, Cruz Label will use its best effort to select the closest possible thread color in its inventory to customer's provided Pantone ® color code. Customers must be aware that because of the substrate of threads are somewhat translucent, color threads can vary in shades depending on how they are weaved. Differences in colors between digital print and actual woven materials are expected due to texture and substrate differences.
12. Shipping
Shipping charges are not included in Cruz Label's quotations and estimates unless specified otherwise. Cruz Label is not responsible for delays and/or damage incurred during shipping. Shipping charges are waived if customer elects for pick up.
13. Claims
Claims for defects, damages, or shortages must be made by the customer in writing no later than 10 calendar days after delivery. If no such claim is made, Cruz Label and the customer will understand that the job has been accepted. By accepting the job, the client acknowledges that Cruz Label’s performance has fully satisfied all terms, conditions and specifications.
14. Right to Subcontract
Cruz Label shall have the right to assign any portion of the work required to another contractor.
15. Privacy Statement
Any information Cruz Label collects from order processing or from any inquiries is not shared with any other company except when it is absolutely necessary to process your order. Your information is only used for contact, billing, and shipping purposes. Your credit card information is never stored by Cruz Label.

16. Promotional Use
